Terms of use

These terms are the agreement between you and RetroWorld for using this site. They are short because the Site is simple: free games and activities, no accounts, nothing for sale. The only money anywhere near it is a voluntary tip on Ko-fi, which buys nothing.

1. Who we are

RetroWorld (retroworld.fun, the "Site") is an independent studio that makes browser games for fun ("we", "us", "our"). Contact: hello@retroworld.fun.

2. Agreeing to these terms

By using the Site you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Site. If you are under 18, you may use the Site only if a parent or guardian has agreed to these terms on your behalf; nothing on the Site requires you to give us personal information to play.

3. What you may do

We grant you a personal, non-exclusive, revocable, non-transferable licence to access the Site and play the games and use the activities in your browser for your own personal, non-commercial entertainment. That is all the licence covers.

4. What you may not do

You must not:

Personal, non-commercial use such as sharing a link, posting a screenshot of your score, or streaming yourself playing is welcome.

5. Our content and your scores

The games, their names, artwork, sounds, code and all text on the Site are owned by RetroWorld and protected by copyright and other intellectual property laws. Every game is an original work; general game mechanics are not owned by anyone, and the Site is not affiliated with, endorsed by or connected to any other game, publisher or console maker.

Your scores, settings and activity results are stored only in your own browser (see the Privacy Policy). We do not hold them, cannot restore them if you clear them, and make no promise that they will survive browser updates or changes to the Site.

If you send us a bug report, you allow us to use what you wrote to fix and improve the Site. We handle it as the Privacy Policy describes, and we may not reply to every report.

6. Nothing is sold here, and tips buy nothing

Everything on the Site is free. There are no purchases, subscriptions, in-game currency, advertisements or sponsorships, and no payment is ever taken through the Site itself. Every game and every feature is available to everyone, whether or not they ever give anything.

The Site links to our page at ko-fi.com/retroworld. A tip given there is a voluntary gift towards running the Site. It buys nothing, unlocks nothing, removes nothing, entitles you to no game, feature, service, priority or say in what gets built, and creates no obligation on us of any kind. Tips are taken and processed entirely by Ko-fi under Ko-fi's terms; we never handle your payment details, and any question about a charge, a cancellation or a refund has to be raised with Ko-fi. If we ever start selling something, these terms and the Privacy Policy will be updated first.

7. Third-party links

The Site links out to Ko-fi; nothing of Ko-fi's runs on the Site itself. Ko-fi and any other site we link to have their own terms and privacy policies, and we are not responsible for their content, their availability or their practices.

8. Analytics

The Site measures visits as described in the Privacy Policy, and Google Analytics runs only if you accept it. The Site shows no advertisements.

9. Availability and changes

The Site is provided free of charge. We may add, change or remove games, activities and features, and may suspend or discontinue the Site, at any time without notice. We may also update these terms; the effective date at the top will change, and continuing to use the Site after a change means you accept the new terms.

10. No warranty

To the fullest extent permitted by law, the Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not promise that the Site will be error-free, uninterrupted or compatible with every device or browser.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive loss, or for loss of data (including scores), loss of profit or loss of enjoyment, arising out of or in connection with the Site, even if advised of the possibility. Because the Site is free and nothing is sold on it, our total liability to you for any claim connected with the Site is limited to the amount you have paid us for the use of it, which is nothing; a voluntary tip on Ko-fi is a gift, not a payment for the Site, and does not change that.

Your local consumer law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy given to you by a law that cannot lawfully be excluded. Where such a guarantee applies and the law permits, our liability is limited to re-supplying the service.

Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot be limited by law in your country.

12. Indemnity

If your breach of section 4 causes a claim against us, you agree to compensate us for the reasonable costs and losses that result.

13. Termination

We may block or restrict access to the Site for anyone who breaches these terms, without notice. You may stop using the Site at any time; clearing your browser's site data removes everything the Site stored on your device.

14. Governing law

We do not ask you to give up the protection of your own country's laws. Any dispute about the Site is governed by the law of the country you live in, and may be brought in the courts of that country.

15. General

If any part of these terms is found unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it. These terms and the Privacy Policy are the entire agreement between you and us about the Site.
